Permanent Terms

 

At Vertex IT Solutions we are so confident that the Consultant provided will meet your expectations that In the unfortunate event that a permanent agreement should be lawfully terminated before the expiration of 100 days The refund to the Client shall be 100% (as long as the invoice for the fee has been settled by the client within 14 days).

The following Terms & Conditions of business for Vertex IT Solutions Ltd. (Vertex) are expressly the only Terms & Conditions currently enforce for Permanent Recruitment, and the acceptance of any details of an applicant or candidate by the client will be deemed as acceptance of these terms.
Fees shall be payable by the Client to Vertex if a candidate is employed by the Client in whatever capacity within six months of the last introduction of the said candidate.
The word Introduction shall be deemed to be the presentation of an applicant whether written, verbal or by electronic means by Vertex to the Client for engagement, whether or not the Client knew of such applicant previously.

If a Client agrees to engage an applicant introduced by Vertex, the Client agrees to forward a copy of the offer letter within seven days of the offer being made to the applicant.
Introduction Fees are calculated as a percentage of the first years basic salary plus any other taxable benefits, which shall include but not be limited to Company car or allowance, retainer or guaranteed bonus etc.

Fees for the placement of permanent staff are as follows:
Gross Salary to £20,000 20% of Annual Salary
£20,001 to £30,000 25% of Annual Salary
£30,001+ 30% of Annual Salary

The above rates shall apply as our standard rates although these may vary subject to volume, regularity of business and Preferred Supplier Status. Any Reduction in rates must be negotiated between the client and Vertex prior to accepting candidates’ details.
Fees are payable by the Client immediately upon receipt of invoice, and a charge may be levied of 8% above the National Westminster Banks standard rate of interest per month for all overdue accounts.
In the unfortunate event that a permanent agreement should be lawfully terminated before the expiration of ten weeks, and upon receipt of written notification. The refund to the Client shall be 100% within two weeks of commencement reducing by 12.5% for each commenced week thereafter.
No refund shall be made to the Client on the grounds of redundancy.
Rebates shall be subject to a minimum service charge of £250 and the Client having settled Vertexs invoice in full within seven days of the candidates commencement date.
If the Client re-engages the candidate within twelve months from termination then the introduction fee shall again apply.

Introductions are confidential and as such if the Client or any representative or employee of the Client refers the candidate to any subsidiary or associate company or other person, company or organisation within twelve months of the last introduction, then the introduction fee shall apply as though the Client themselves had engaged the candidate.

Whilst Vertex shall endeavour to take every reasonable precaution to ensure the suitability of a candidate we cannot be held responsible for any loss, damage, expense of delay or injury to persons however occasioned by any candidate introduced by Vertex, even if such act or omission is negligent, fraudulent or dishonest.

The client shall be responsible for establishing the authenticity of any references concerning the candidates skills, qualifications, medical conditions, general integrity and status to work, whether required by either them selves or law.These terms may not be varied except by the express permission of a director of Vertex in writingThe laws of England shall govern the interpretation and performance of these Terms and Conditions
